Please read these terms carefully before using PulseApp. By creating an account or using the app, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PulseApp ("PulseApp," "we," "us," or "our") governing your access to and use of the PulseApp mobile application, this website, and all related services (collectively, the "Service").

By downloading, installing, or using PulseApp, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately stop using the Service and delete the application.

2. Description of Service

PulseApp is a professional customer relationship management (CRM) application designed exclusively for mortgage loan officers and mortgage professionals. The Service enables you to:

  • Organize and manage your broker and client contact lists
  • Prioritize outbound calls using an automated scoring system
  • Log call outcomes, notes, and follow-up schedules
  • Track call history and productivity analytics
  • Import and export contact data via CSV or XLSX
  • Receive push notifications for scheduled follow-up calls

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you for any such modification, suspension, or discontinuation.

3. Eligibility & Account Requirements

To use PulseApp, you must:

  • Be at least 18 years of age
  • Be a licensed or actively working mortgage professional, loan officer, or mortgage broker (or be using the Service on behalf of one)
  • Have a valid email address and create an account with accurate information
  • Have access to a compatible iOS device running a supported version of iOS

You are responsible for maintaining the security of your account credentials. You must not share your login information with any third party. You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, you must notify us immediately at info@mobile-crm-app.com.

We reserve the right to suspend or terminate accounts found to be in violation of these Terms, used for non-professional purposes, or associated with fraudulent activity.

4. Subscription Plans & Billing

PulseApp operates on a free-trial-to-paid model with the following tiers:

  • Free Trial — 60 days of full access with up to 10,000 contacts. No payment required. After the trial ends, you must pick a paid plan to continue adding new contacts (existing data stays accessible).
  • Basic Plan — Up to 100 contacts, $149.99/year, billed annually via the Apple App Store.
  • Pro Plan — Up to 400 contacts, $299.99/year, billed annually.
  • Premium Plan — Up to 10,000 contacts, $399/year, billed annually.
All paid subscription billing is processed exclusively through the Apple App Store. We never directly collect, store, or process your payment card details. Apple's payment terms and refund policies apply to all transactions.

Auto-Renewal: Paid subscriptions automatically renew at the end of each annual billing period at the then-current price, unless you cancel at least 24 hours before the renewal date through your Apple ID subscription settings.

Price Changes: We will provide at least 30 days advance notice of any price changes. Continued use of the Service after a price change constitutes your acceptance of the new price.

No Refunds: All purchases are final and non-refundable except as required by applicable law or by Apple's refund policy. If you believe you are entitled to a refund, contact Apple Support directly.

Contact Limits: If your active contact count exceeds the limit of your current plan (for example, due to a downgrade), you will not be able to add new contacts until you either upgrade your plan or archive enough contacts to fit within your limit.

5. Cancellation & Downgrade

You may cancel your subscription at any time through your Apple ID subscription settings. Upon cancellation:

  • Your paid plan remains active until the end of the current billing period
  • At the end of the billing period, your account enters view-only mode — you can read and export your data, but cannot add new contacts or place new calls
  • Your existing contacts, call history, and data remain intact — they are not deleted
  • To re-activate, simply subscribe to any paid plan again

Cancellation does not entitle you to a prorated refund for any unused portion of a prepaid annual subscription.

6. Acceptable Use

You agree to use PulseApp only for lawful, professional purposes consistent with applicable law, including the Telephone Consumer Protection Act (TCPA), Do Not Call regulations, and all applicable state and federal laws governing telemarketing and outbound calls.

You expressly agree that you will not:

  • Use the Service to contact individuals who have requested not to be called or who are registered on the National Do Not Call Registry
  • Upload, store, or process contact data you do not have legal authorization to use
  • Attempt to reverse-engineer, decompile, or extract the source code of the application
  • Use the Service to transmit spam, unsolicited communications, or malicious content
  • Share your account credentials or allow third parties unauthorized access to your account
  • Use automated bots, scrapers, or scripts to access the Service
  • Attempt to circumvent subscription limits or access restrictions (this includes tampering with trial end dates or other anti-abuse measures)
  • Use the Service for any illegal or unauthorized purpose

Violation of these acceptable use provisions may result in immediate termination of your account without refund and, where applicable, referral to law enforcement.

You are solely responsible for ensuring your use of PulseApp complies with all applicable telemarketing laws, including the TCPA. PulseApp is a tool — how you use it is entirely your responsibility.

7. Your Data & Contact Information

You retain full ownership of all contact data, call logs, and notes you create within PulseApp. We do not claim any intellectual property rights over your data.

You represent and warrant that:

  • You have the legal right to store and use all contact information you input into the Service
  • The contacts you manage through PulseApp have consented (or are exempt from consent requirements) to receive your outbound calls under applicable law
  • You will not use the Service to store sensitive personal information beyond what is necessary for legitimate mortgage business purposes

By using the Service, you grant PulseApp the limited right to store, sync, and display your data solely for the purpose of providing the Service to you. See our Privacy Policy for full details on how your data is stored and protected.

8. Intellectual Property

The PulseApp application, including its design, branding, scoring algorithms, user interface, and all related software, is owned by PulseApp and protected by United States and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the application on your personal iOS device solely for the purposes described in these Terms. This license does not include any right to:

  • Reproduce, modify, or create derivative works of the application
  • Distribute, sell, or sublicense the application to any third party
  • Use any PulseApp trademarks, logos, or branding without prior written consent

All rights not expressly granted in these Terms are reserved by PulseApp.

9. Third-Party Services

PulseApp integrates with the following third-party services to deliver the Service. By using PulseApp, you also agree to their respective terms:

  • Supabase — provides our cloud database, authentication, and realtime infrastructure. Subject to Supabase's Terms of Service.
  • Apple App Store — handles all subscription billing and payment processing. Subject to Apple's Terms of Service and Media Services Terms.
  • Hostinger — hosts this website. No personal data beyond standard server logs is shared.
  • Expo / React Native — the app framework. No personal data is shared with Expo.

We are not responsible for the availability, reliability, or practices of any third-party service. Disruptions to any third-party service may affect your ability to use PulseApp.

10. Disclaimers & Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED

The call duration timer feature provides an approximate call duration based on time spent in the phone dialer application and is not a legally precise record of connected call time. You should not rely on this feature for regulatory compliance, billing purposes, or any purpose requiring exact call duration records.

The priority scoring and queue ranking system is a tool to assist your workflow and does not constitute financial, legal, or business advice. You are solely responsible for your business decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULSEAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or corruption of contact records
  • Business interruption or loss of goodwill
  • Any damages arising from TCPA violations or regulatory penalties resulting from your use

IN NO EVENT SHALL PULSEAPP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless PulseApp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms
  • Your violation of any applicable law, including TCPA or Do Not Call regulations
  • Your use or misuse of the Service
  • Any contact data you upload, store, or use in violation of third-party rights

13. Account Termination

By You: You may delete your account at any time from Settings → Security → Delete Account. Deletion permanently removes all your data from our systems within 30 days. This action is irreversible.

By Us: We may suspend or terminate your account at any time if:

  • You violate any provision of these Terms
  • We reasonably suspect fraudulent, abusive, or illegal activity on your account (including circumvention of trial limits or anti-abuse measures)
  • We are required to do so by law or court order
  • You fail to pay applicable subscription fees

If we terminate your account for cause, you forfeit any remaining subscription period without refund. If we terminate your account without cause, we will provide a prorated refund for any unused prepaid subscription period.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Notify you via email at the address associated with your account
  • Display an in-app notification at least 14 days before changes take effect
  • Update the "Last updated" date at the top of this document

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration shall be conducted in English in Florida, USA.

Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against PulseApp. All disputes must be brought individually.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.
